1. Who we are
gradedmarket.eu ("Graded Market", "we", "us") is a marketplace connecting buyers and verified European sellers of graded trading card game (TCG) cards. "Graded Market" is a trademark of CEDAYA, a French company registered under SIREN 812 748 655 with headquarters at 117, rue de Charenton, 75012 Paris.
2. Accepting these terms
By creating an account, listing a card, or completing a purchase, you agree to these Terms of Service. If you don't agree, please don't use the service. These terms apply in addition to our Terms of Sale, Seller Agreement, Privacy Policy, Cookie Policy and Refund Policy. Each sale on the marketplace is additionally governed by the Terms of Sale between the Buyer and the Seller, and every Seller is bound by the Seller Agreement.
3. Accounts
You must be at least 18 years old and able to enter into a binding contract. You're responsible for the activity on your account and for keeping your credentials secure. We may suspend or close accounts that violate these terms, applicable law, or the spirit of the marketplace.
4. Buying cards
When you place an order, your payment is held by Stripe ("escrow") until the seller confirms shipment and the item is delivered. If the card doesn't arrive, arrives damaged, or materially differs from the listing, you can open a dispute within 3 days of delivery for a full refund.
5. Selling cards
Only identity-verified, approved sellers may list cards. Every listing must accurately reflect the slab (grader, grade, cert number, photos) and the card must be physically in a European vault before it goes live. Misleading, fraudulent or duplicated listings will be removed and may result in account termination and reversal of funds.
6. Fees
Buyers pay the listed price plus any applicable VAT and shipping. Sellers pay a commission on each successful sale, disclosed in their seller dashboard and deducted automatically via Stripe Connect at the time of payout.
7. Prohibited items
You may not list counterfeit slabs, tampered cases, cards with altered certificates, reprints labelled as originals, or any item whose sale violates European law. We reserve the right to verify certs against the grading company's database at any time.
8. Liability
Graded Market is a marketplace, not a party to the sales contract between buyer and seller. To the extent permitted by law, our liability is limited to the transaction amount. Nothing in these terms limits rights you have as a consumer under EU law.
9. Governing law
These terms are governed by French law. Disputes will be handled by the competent courts in Paris, without prejudice to mandatory consumer-protection rules in your country of residence.
10. Changes
We may update these terms from time to time. Material changes will be announced by email and on the site at least 14 days before they take effect.
